Terms of Agreement
These Terms of Agreement (TOA) are incorporated by reference in any rental agreement with Moss Entertainment, LLC (Moss) or invoice for rental of any item including parts and accessories there of (Item). If any Item identified in any such agreement or invoice becomes damaged at any point during the rental period, the Renter (as identified in the agreement or invoice), any parties with authority over the Renter, or having authority delegated by the Renter, are responsible for all costs of having the Item fixed, including, but not limited to, transportation of the Item for repair and return to Moss, all additional contracts voided by any Item being unavailable, and the cost of diagnosis and repair or, if necessary, the full and actual cost of replacement with the same or highly similar Item. Should Moss be able to, in his own judgement, perform any such repairs himself, his time will be billed at $60.00 per hour, billed in 1 hour increments. If any Item should be stolen, lost, misplaced or otherwise cannot be returned to Moss within 15 days of the end of the rental period, Renter is responsible for the full and actual cost of replacement with the same or highly similar Item. Terms of transportation are listed in the rental agreement or invoice. Renter is responsible for any item throughout the entirety of the rental period. The rental period is identified in the rental agreement or invoice.
If Renter fails to return Item at the end of the rental period, Renter will still be responsible for any damages to any Item until it is returned. In addition, any Item returned after the rental period will be billed at the per day rate until returned, plus any costs incurred by Moss or other damages incurred due to the late return.
Compensation for the rental period is identified in the rental agreement or invoice. Should no per day rate be identified in the rental agreement or invoice, per day rates will be calculated as 1/5th the weekly rate listed on invoice before adjustment. All costs and fees identified in this TOA are subject to terms of payment in the renal agreement or invoice.
A 50% deposit is due at time of reservation unless otherwise agreed. In the event Renter chooses to cancel this agreement, all reservation deposits will be refunded at 100% >120 days and 50% with >90 days notice from the start of the rental period. Any cancelation at or after 90 days notice from the start of the rental period will not receive a refund of reservation deposit. A 10% late fee per day will be added to all late payments, late fees may be waved at the discretion of Moss.
